Graydon Head & Ritchey’s Commercial Real Estate Industry Group regularly represents clients in judicial and quasi-judicial proceedings as well as mediations and arbitrations involving real estate matters.  This includes matters such as zoning and plan review, tax valuation and appeals, condemnation proceedings, and operational issues such as tenant disputes, eviction proceedings and maintenance and property management contracts.  The real estate team works includes litigators to ensure that, regardless of the nature of the proceeding, it is properly staffed with lawyers experienced in both real estate and litigation or arbitration, as appropriate. We have also been engaged in complex annexation proceedings.

Zoning and permitting issues frequently arise in development and construction projects.  Our counseling can help prevent these issues from stalling a project. Our attorneys have both successfully obtained and contested zone changes, conditional uses, and variances for numerous clients through both the administrative and litigation process, appearing before planning and zoning commissions and boards of zoning appeals. We have also litigated complex zoning matters at state, administrative, trial appellate and supreme court levels.

  • Coordinated national and local historic register listings, including local/state review of certified historic rehabilitative expenditures.
  • Coordinated zone changes for diversified projects including residential and commercial sites.
  • Worked through complex mechanic's lien issues.
  • Enforced rights of landlord in various matters involving shopping mall tenants.
  • Litigated complex zoning matters at state administrative, trial appellate, and supreme court levels.
  • Negotiated global settlement on behalf of sellers of a shopping mall of all litigation arising from sale.
  • Obtained plaintiff jury verdict after trial in residential real estate structural defect dispute.
  • Coordinated annexation strategies involving township-municipal interactions.
  • Represented numerous business and commercial property owners in highway appropriation areas and economic development cases (most recently in Norwood, Ohio)
